Selling a Home in a 55+ Community in Florida
Age rules, buyer approvals and land leases shape every 55+ resale
Selling in a Florida 55+ community works like any other sale with two extra layers: your buyer has to fit the community's age rules, and in most communities the buyer also needs approval from the HOA, condo association or park owner before closing. Pricing matters more than usual right now, because Zillow's Florida condo index, which covers a lot of 55+ housing, is $262,592 and down 3.9% over the past year.

Who can buy: the 80% rule and your community's own limits
Florida 55+ communities operate under the federal Housing for Older Persons Act. At least 80% of occupied units must have at least one resident aged 55 or older, and the community has to verify ages with surveys or affidavits updated at least every two years. That 80% is a floor. Many communities write stricter rules into their documents: every unit must have a 55+ occupant, residents under a certain age cannot live there full-time, or guest stays are limited.
For a seller, that means three things:
- Read your own declaration, bylaws or park rules before listing, so you know exactly who qualifies.
- Put the age requirement in the listing and in the contract, so an unqualified buyer does not tie up the home.
- If you inherited the home and are under 55 yourself, you can usually still own and sell it, though occupancy may be restricted while you do.

Three ownership types, three different sales
What you are actually selling depends on how the land is held.
- Land lease community. You own the home and lease the lot from the park. You sell the home only, often with a title like a vehicle's, and the buyer takes on the lot lease. These sales follow Florida's Mobile Home Act (Chapter 723).
- Owned lot with an HOA. A normal real estate sale: deed, title insurance, doc stamps, plus HOA approval and the HOA disclosure summary.
- Condo. A deeded unit with association approval, the condo document package, and the buyer's right to cancel within 7 days (excluding weekends and legal holidays) after receiving the documents.
Some 55+ developments are single-family active-adult communities with CDD assessments on the tax bill. Those sell like any deeded home, with the CDD notice in the contract.

Seller costs on a $375,000 sale
| Sale price (typical home value) | $375,000 |
| Deed doc stamps ($0.70 per $100) | −$2,625 |
| Owner's title policy | −$1,950 |
| Settlement, lien search and recording (estimate) | −$1,200 |
| Before commission and mortgage payoff | $369,225 |
Commissions are negotiable and not included; neither are prorated property taxes, HOA or condo estoppel fees, repairs or your mortgage payoff. Who pays the owner's title policy follows county custom and your contract. For your exact numbers use the closing cost calculator.
Selling in a land lease community
Land lease resales are where sellers get surprised. Under Florida law, a buyer who wants to live in the park can become a resident subject to the park owner's approval, and that approval may not be unreasonably withheld. Park rules can set a screening process. If the buyer is not approved, the buyer can cancel the purchase before closing, so build park approval into your contract timeline with its own deadline.
- The buyer can generally assume the rest of your current lot rental agreement and your prospectus. After that agreement expires, the park can raise the lot rent if the increase was disclosed before occupancy and fits the prospectus.
- Lifetime leases and certain renewal terms are generally not assumable unless the lot agreement allows it or the buyer is your spouse.
- Lot rent is part of the buyer's monthly budget, so it moves your price. Two identical homes in parks with different lot rents will not sell for the same number.
Give buyers the current lot rent, the prospectus and the park rules up front. It shortens the approval and keeps the deal from stalling.
Pricing a 55+ resale against today's numbers
The best comps are recent sales inside your own community, same model or floor plan, adjusted for condition, roof age, updates and lot position. Statewide data gives the backdrop. The Florida condo index on Zillow is 16.3% below its December 2023 peak, while all homes are 6.9% below their June 2024 peak and up 18.6% over five years. If you bought before 2021, you likely still have gains. If you bought in 2022 or 2023, check closely before you set a price.
Census data shows where older buyers already are. The 65+ share is 85.2% in The Villages, 29.5% in Palm Coast, 28.0% in Largo and 27.7% in North Port. In The Villages, Zillow's condo value is $367,342, close to its all-homes value of $392,424, which tells you how different a dedicated retirement market can look from a typical city. Price your home against sales in its own community first.
Fees and paperwork buyers will ask about first
55+ buyers are often on a fixed income, so the monthly number gets as much attention as the price. Have these ready before the first showing:
- HOA or condo fees, what they include, and any amenity, golf or clubhouse charges.
- CDD assessments on the tax bill, if any.
- Any special assessment that has been voted or is under discussion.
- For condo buildings of three or more habitable stories, the milestone inspection and SIRS status. Lenders and buyers both ask.
- The buyer approval application, its fee and how long the board or park usually takes.
Estoppel letters confirm what you owe the association at closing. Fees are capped by statute, and the contract usually assigns them to the seller.
Selling to buyers who live somewhere else most of the year
A large share of 55+ buyers in Florida are relocating or buying a seasonal home, and many tour from out of state on a short trip. That changes how you prepare. Good photos, a floor plan with room sizes and a video walk-through let a buyer shortlist your home before the flight. A one-page sheet with fees, lot rent if any, the age rule, pet rules and the approval steps saves a round of questions. Approval interviews can often be done by phone or video, and Florida closings can be done by mail or remote online notarization, so a buyer who has gone home can still close. Ask your association or park how long approvals took on the last few sales, and leave that much room in the contract plus a margin for holidays.
Taxes, homestead and family situations
If the home is your homestead and you buy another Florida homestead within three years, you can carry up to $500,000 of your Save Our Homes benefit to the new home. That portability can matter more than a few thousand dollars on price. Moving out of state ends the benefit.
On the federal side, a main home owned and lived in for 2 of the last 5 years qualifies for the exclusion of up to $250,000 of gain ($500,000 married filing jointly). Florida has no state income tax. Heirs selling an inherited home generally get a stepped-up basis, and sales by a trustee or under a power of attorney need the right documents to the title company early. This isn't legal or tax advice; talk to a CPA, and to an estate attorney if the home is in a trust or estate.
Common questions
Can I sell my 55+ home to someone under 55 in Florida?
Sometimes. Federal law requires at least 80% of occupied units to have a 55+ resident, but many communities set stricter rules. Your declaration, bylaws or park rules decide whether an under-55 buyer can own or live there.
Does the park have to approve the buyer of my mobile home?
In a Florida land lease park, the buyer becomes a resident subject to the park owner's approval, which may not be unreasonably withheld. If the buyer is not approved, they can cancel before closing.
Can the buyer keep my lot rent?
Generally the buyer can assume the remainder of your current lot rental agreement and your prospectus. After it expires, rent can rise if the increase was disclosed and fits the prospectus. Lifetime leases are usually not assumable except by a spouse.
Why is my 55+ condo taking longer to sell?
Florida's condo index is down 3.9% over the past year, and buyers look hard at fees, reserves, special assessments and milestone inspection status. Pricing off older comps is the most common reason a 55+ condo sits.
